can you sell home when there is no mortgage assignee?

It seems as if some lawyers have the same idea I do, and are already starting class action suits to get mortgages rescinded. They aren't currently going after cases where mortgage ownership was poorly documented, but it is clearly possible to challenge lenders in court and have the mortgage vacated if they have erred.
